{"id":2034,"date":"2020-09-11T11:50:08","date_gmt":"2020-09-11T09:50:08","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=432898"},"modified":"2020-09-11T11:50:08","modified_gmt":"2020-09-11T09:50:08","slug":"bill-to-introduce-new-laws-for-domestic-workers-in-south-africa","status":"publish","type":"post","link":"https:\/\/interwebdev.co.za\/index.php\/2020\/09\/11\/bill-to-introduce-new-laws-for-domestic-workers-in-south-africa\/","title":{"rendered":"Bill to introduce new laws for domestic workers in South Africa"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2019\/06\/Exit-Sign-Job-Quit.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p>Minister of Employment and Labour Thulas Nxesi introduced the Compensation for Occupational Injuries and Diseases Amendment Bill in parliament on Thursday (10 September).<\/p>\n<p>According to an attached explanatory memorandum, the bill will make a number of amendments to the existing Compensation for Occupational Injuries &amp; Diseases Act \u2013 including changes to the existing definition of an \u2019employee\u2019 to include domestic workers.<\/p>\n<p>As it currently stands the Compensation for Occupational Injuries and Diseases Act states that workers are entitled to claim compensation under specific circumstances \u2013 however, this does not cover domestic workers and gardeners.<\/p>\n<p>In seeking compensation, domestic employees are currently only able to claim against the Unemployment Insurance Fund and perhaps make a civil claim against the employer.<\/p>\n<p>The new bill aims to change this by making the Act apply to domestic workers as well.<\/p>\n<p>The bill also wants to introduce regulations to address \u201cthe tendency of some employers to dismiss employees on the basis of occupational injuries or diseases,\u201d Nxesi said.<\/p>\n<p>\u201cChapter VII(A) seeks to introduce the concept of a multi-disciplinary employee-based process of rehabilitation and reintegration of injured employees or employees who contracted occupational diseases,\u201d the explanatory memorandum states.<\/p>\n<p>This means an employer will have to <strong>exhaust all rehabilitation and reintegration processes<\/strong> before laying off an employee, Nxesi said.<\/p>\n<p>\u201cEmployers will be incentivised for full compliance with the provisions of this chapter by way of rebates on their annual assessments.\u201d<\/p>\n<p>You can read the full bill below.<\/p>\n<hr>\n<p><strong>Read: <a href=\"https:\/\/businesstech.co.za\/news\/business\/432632\/the-skills-which-are-most-difficult-to-find-in-south-africa-right-now\/\" target=\"_blank\" rel=\"noopener noreferrer\">The skills which are most difficult to find in South Africa right now<\/a><\/strong><\/p>\n<p><a href=\"https:\/\/businesstech.co.za\/news\/business\/432898\/bill-to-introduce-new-laws-for-domestic-workers-in-south-africa\/\">Source: BusinessTech<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Minister of Employment and Labour Thulas Nxesi introduced the Compensation for Occupational Injuries and Diseases Amendment Bill in parliament on Thursday (10 September).
